What is a Separation Agreement?

A Separation Agreement is a legal document made between two individuals in one of the following types of relationships:

  • Married
  • Civil partnership
  • Cohabiting

It’s used by couples who are separating but not divorcing immediately.

It typically sets out the terms of the separation, including:

  • Financial responsibilities
  • Living arrangements
  • Child care arrangements
  • How shared assets or debts will be managed

Couples can use a legal Separation Agreement to avoid disputes and maintain clarity while separated. It provides evidence of the couple’s mutual decisions.

This type of agreement is not automatically legally binding in the UK. However, courts may uphold a mutual Separation Agreement it if it’s properly prepared, signed, and both parties received independent legal advice.

This agreement can be temporary or long-term, depending on the couple’s situation.

It’s often used as a step before you begin divorce proceedings. If you want to remain legally married but live separate lives, this document could also be a good solution.

Types of Separation Agreements

There are a few different types of this agreement. You should choose the one that best suits your situation:

Marriage Separation Agreement

A marriage Separation Agreement is used by couples who are legally married or in a civil partnership. It allows them to record their decisions about shared property, bills, and child-related matters without applying for a divorce right away.

Financial Separation Agreement

A financial Separation Agreement outlines how money, savings, debts, and financial responsibilities will be divided.

It may include arrangements for:

  • Spousal maintenance
  • How to handle joint accounts
  • Division of pensions

This type of agreement could fit your situation if there are properties or significant financial assets involved.

Unmarried Separation Agreement

An unmarried Separation Agreement is suitable for couples who are not married but have been living together.

Cohabiting couples typically don’t have the same legal protections as married ones. However, this document can be used to clearly decide who owns what and how responsibilities will be shared after separation.

Things to include in a Separation Agreement

Names and address of both parties

Include the full legal names and current addresses of each person in the relationship. This confirms who the agreement applies to and shows mutual consent to separate.

Date of separation

Clearly state the exact date the couple began living separately. This date may later support legal proceedings like divorce or benefits claims.

Property and possessions

Specify who will remain in the shared home and who will move out. List how furniture, vehicles, and other personal items will be divided between both parties.

Finances and debts

You must outline each party’s financial responsibilities. Explain how the following will be managed:

  • Bank accounts
  • Credit cards
  • Savings
  • Pensions
  • Joint loans
  • Childcare arrangements

Detail who the children will live with, and how often the other parent will see them. You should also explain how major decisions like schooling or healthcare will be handled.

Spousal maintenance

If one person will pay the other for financial support, include how much, how often, and for how long. Make clear whether the support is temporary or ongoing.

Household bills

Generally, you should make sure that costs are divided fairly. List which party is responsible for paying:

  • Mortgage or rent
  • Utility bills
  • Council tax
  • Other ongoing home-related costs

Future dispute resolution

Explain how future disagreements will be resolved without going to court. Options typically included are mediation or independent legal advice.

Divorce proceedings (if applicable)

Note whether the separation agreement is intended to support a future divorce. Courts may consider it if it reflects a fair and voluntary agreement.
